Scope of these terms of use

These terms of use govern a user's (you/your) access to “Mazda Manuals” at mazdamanuals.com.au (Mazda Manuals). If you do not agree to these terms, do not use this website.

Use of the Mazda Manuals website is only permitted on the basis of these terms of use and requires the user to have authorised access from Mazda Australia.

Mazda Australia reserves the right to amend, supplement or replace these terms of use at any time.

Vehicle repair and maintenance information accessible through this website is provided in accordance with the Federal Chamber of Automotive Industries (FCAI) Voluntary Code of Practice for Access to Service and Repair Information for Motor Vehicleshttp://www.fcai.com.au/news/codes-of-practice/index/year/all/month/all/publication/62

Registration and use

Authorised access will be granted upon registration by a user.  Registration is permitted upon the condition that the user is either an undertaking belonging to the Authorised Mazda Network or is directly or indirectly involved in the repair and maintenance of Mazda motor vehicles.

On registration the user will be provided with a user name and password for use in logging in to the Mazda Manuals website. The user must keep the user name and password strictly confidential and ensure that unauthorised persons never gain access to them.

The details requested on registration must be provided by the user accurately and in full. If the details given by the user change after the initial registration, the user agrees to correct or update the information immediately.

By registering and logging in to the Mazda Manuals website, the user is agreeing to these terms.

Mazda Manuals Content Rights

The Mazda Manuals website contains data and information the ownership and use of which is protected by law.

The user may access and view subscription protected information upon payment. Use or exploitation of the information for purposes other than the repair and maintenance of Mazda motor vehicles including reproduction, alteration or inclusion in publications or websites, is only allowed with the prior written permission of Mazda Australia or the legal owner of the information concerned. This also applies to any form of redistribution or forwarding of Mazda Manuals website content.

Unauthorised use of the Mazda Manuals website and/or unauthorised forwarding of information from the Mazda Manuals website may result in claims for damages against the user by Mazda Australia or other third party owners of the information which is used or forwarded without authorisation.

Mazda Australia and/or Mazda Motor Corporation own or are licensed to use the intellectual property rights in the Mazda Manuals website and the content and information contained in it. Such rights (including rights in brand names, logos and trademarks) remain without exception with Mazda Australia / Mazda Motor Corporation.

Responsibility for content

If the user enters data and information in the Mazda Manuals website, the user is fully responsible for such data and information. The user indemnifies Mazda Australia in full against any and all third party claims arising from or in any way connected with the data and information entered by the user (e.g. due to infringement of copyright or trade-mark rights).

Mazda Australia and Mazda Motor Corporation are not liable for the accuracy or completeness of information and content from third parties provided on the Mazda Manuals website.  Information which is not Mazda Australia’s own data but can be accessed via the Mazda Manuals website is not subject to checks by Mazda Australia, including whether it contains damaging software (e.g. viruses) and users use such information at their own risk.

The Mazda Manuals website may contain links and/or references to third party websites. Mazda Australia accepts no responsibility for the content of these third party websites and does not adopt them and/or their contents as its own.  Mazda Australia is not liable for the quality, accuracy and/or completeness of third party information in such links and references. This includes all information and contents entered by the users of the Mazda Manuals website and/or Mazda Australia dealers.

Although Mazda Australia makes continuous efforts to keep the Mazda Manuals website virus free, it does not give a guarantee that the website will be free from viruses nor does it accept liability for any loss or damage which user may suffer as a result of the website containing or spreading a virus. Before downloading data, software or documentation from the Mazda Manuals website, the user must take reasonable security precautions and use suitable virus scanners for your own protection and also to prevent the Mazda Manuals website being infected with viruses.

Mazda Australia accepts no liability for loss or damage caused directly or indirectly by the use of files downloaded or accessed from Mazda Manuals.

The data and information contained on the Mazda Manuals website has been compiled by Mazda Australia using the best of its knowledge but Mazda Australia does not guarantee that the data and information is complete, accurate and up to date.

Rules for password use and responsibility

The user has sole responsibility for protecting their account for use of the Mazda Manuals website against misuse.  If you discover that your password is known to unauthorised persons or some other risk of misuse exists, you must notify Mazda Australia of this immediately. Mazda Australia will then take appropriate action to bar the password in question.

Mazda Australia accepts no liability for loss or damage arising out of misuse of passwords by, or permitted by the user.

Access to vehicle repair and maintenance information subject to charges

Mazda Australia offers users who are not authorised Mazda Repairers access to vehicle repair and maintenance information upon payment of a fee. Fees for access to the vehicle repair and maintenance information vary in accordance with the respective periods of time for which access is granted. Access will be granted in accordance with the following periods of time:

  • 1 Day
  • 7 Days
  • 1 Month
  • 1 Year

Please note that with the purchase of access for 1 day, the registration day counts as a full day. Fees can only be paid via the online payment service.

Warranty and liability

Mazda Australia does not guarantee that the Mazda Manuals website will be accessible and trouble-free at all times. This includes, but is not limited to situations in which access to the Mazda Manuals website is affected by problems beyond the control of Mazda Australia. Mazda Australia will however use all reasonable endeavours to correct operational and technical issues within its control causing access problems but does not guarantee that such issues can or will be resolved within any specific period.

Barring of access, cancellation, deletion of accounts

The right of use is granted for an indefinite period and may be cancelled by the user at any time without notice.  Where user cancels the right of use, the user will not be entitled to a refund of any unused portion of paid access. Mazda Australia may cancel a user's access without notice where user has breached these terms of use and the user will not be entitled to a refund of any unused portion of paid access.  Mazda Australia may cancel a user's access for any other reason by giving user 14 calendar days’ notice, which notice may be given by letter or email to the user's last known address.  Where such notice is given by Mazda Australia, the user will be entitled to a refund of any unused portion of paid access.

Final provisions

These terms of use are governed by the laws of the state of Victoria and the courts of Victoria have exclusive jurisdiction to hear any disputes arising from these terms of use.
